An unsung American hero of sorts passed away recently. Dollree Mapp comes from a line of Americans who, out of idealism, desperation, or both, got their backs up and sought to assert the rights guaranteed to them by the Constitution. Of improbable circumstance and improbable nature, Dollree Mapp’s simple act of defiance touched us all.

The Fourth Amendment requires that:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Dollree Mapp in Search and Seizure

Except in cases of probable cause, the police need a warrant to search your house without your consent in order for anything they find to be admissible in court.  But that wasn&#;t always the case.  In fact, until , the police could barge right in and start searching.  Anything they found was perfectly fine to use against you in court, warrant or no warrant.  Sure, they were supposed to get one &#; but it wasn&#;t required.  So why bother?

This changed because of one woman: Dollree Mapp.  In , a bomb went off in the home of Don King (yeah, that Don King).  Cleveland police went to Mapp&#;s house looking for a suspect.  When she refused to let them in without a warrant, they went in anyway.  In addition to the suspect, police found a stash of pornographic material and Mapp was arrested and convicted on obscenity charges

Mapp appealed her conviction on the grounds that the search of her house without a warrant or probable cause violated her Fourth Amendment protection against &#;unreasonable searches and seizures.&#;  On June 19, &#; 56 years ago today &#; the Supreme Court agreed.  

Not to be Forgotten: One Cleveland Woman’s Case Changed the Rule of Law

Life changing moments often come at us out of the blue and so it was for Dollree Mapp.

Early on May 23, , Dollree was alone in her Cleveland home, enjoying her privacy. When her doorbell rang, she had no idea that what happened next would change state laws on how evidence should be handled and establish her legacy as a woman who spoke up for her rights.

That morning three plainclothes Cleveland police officers visited Dollree in response to a tip regarding the location of a suspect in a recent bombing of the home of future boxing promoter Don King. The officers asked to enter Dollree’s house. She called her lawyer, who instructed her not to let them in without a search warrant.

The officers forced themselves into her home and, when Dollree again asked to see a warrant, one of the officers held up a piece of paper. She snatched the paper and hid it in her blouse. After retrieving the paper, an officer handcuffed Dollree and proceeded to search her home. The search resulted in the discovery of risqué books, sketches, and “lewd and lascivious” photographs, which Dollr

Time is not always kind to the people whose names get attached to landmark legal cases. Ernesto Miranda, the defendant whose Supreme Court case forced police to inform suspects of their basic rights (“You have the right to remain silent…”) was stabbed to death in a skid-row bar. Clarence Gideon won a Supreme Court case, Gideon v. Wainwright, that established the right of poor defendants to court-appointed lawyers. When he died a decade later the former mayor of his hometown recalled him as a “no-good punk.” It fell to the American Civil Liberties Union to put a marker on his grave.

Before the Gideon ruling, before Miranda , there was Mapp v. Ohio, the Supreme Court decision some legal scholars credit with launching a “due process revolution” in American law. The Mapp ruling changed policing in America by requiring state courts to throw out evidence if it had been seized illegally. The woman behind the ruling, Dollree “Dolly” Mapp, died six weeks ago in a small town in Georgia, with virtually no notice paid. She was 91, as best we can tell.
